The government has set out its commitment to provide one million more homes and grant planning permission on 90% of suitable brownfield sites for housing by 2020.
To achieve this aim, a new duty has been placed on local planning authorities through the Housing and Planning Act 2016 to prepare, maintain and publish a register of brownfield land (also known as previously developed land), which the council has assessed as being potentially suitable for residential development. Brownfield land is defined in Annex 2 of the National Planning Policy Framework.
This register is known as the Brownfield Land Register. The purpose of the Brownfield Land Register is to provide up-to-date, publicly available information on brownfield land that is suitable for housing. The intention is that it will provide certainty to developers and communities, encourage investment in local areas, and bring forward derelict and underused land for new homes.
Sites on the Brownfield Land Register are required by regulations to meet the following criteria:
- the land has an area of at least 0.25 hectares or is capable of supporting at least five dwellings
- the land is suitable for residential development
- the land is available for residential development and
- residential development of the land is achievable
The regulations require the register to be kept in two parts:
- Part 1 of the Brownfield Land Register will comprise all brownfield sites that meet the criteria above and have been assessed as appropriate for residential development
- Part 2 of the Brownfield Land Register is a subset of Part 1. Part 2 will comprise only those sites in Part 1 that the local planning authority has decided that the land would be suitable for a grant of ‘permission in principle’ for residential development. The registers for both Lewes District and Eastbourne Borough do not currently have any Part 2 sites
The Register will be updated at least annually.
The inclusion of sites on the Part 1 of the Register does not necessarily mean that those sites will be developed; it means that they are potentially suitable for residential development in the future.
